FYI REPORT
Current copyright law was adopted in 1976 and went into effect in 1978.
"Copyright protection subsists...in original works of authorship fixed in any tangible medium of expression, now known or later developed, from which they can be perceived, reproduced, or otherwise communicated, either directly or with the aid of a machine or device."
Exceptions & Exemptions; Section 107: Fair Use Privilege
This site is exempt from certain restrictions above by:
Section 107 of the Copyright Law
These Four factors were considered in determining whether or not a particular use of a copyrighted work is fairly used in our web site; according to law:
1. Purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
2. Nature of the copyrighted work;
3. Amount and substantiality of the portion used in relation to the work as a whole; and
4. Effect of the use upon potential market for or value of the work.
And is further exempt:
As of March 1, 1989, placement of a copyright notice on works became optional when the US joined the Berne Convention. Therefore all works after 1989 do not necessarily have to have a copyright notice.
Works prior to 1 March 1989 without a distinct copyright notice are considered to be in the Public Domain
And those Works which do recognize a Copyright; have been granted to this site by
'Individual Rights' and for use on this site only; any use of an article, photo, or graphic on this site does not mean it is in the Public Domain except where the above laws apply.
Further:
No individual or group of individuals may claim sole ownership of any article, photo, or graphic which was reproduced at taxpayer expense; or was written, photographed or drawn while a person was in the employ of the US Government during military service while assigned to carryout that specified task/or duty as a correspondent, combat photographer or military illustrator et. al. All published works reproduced by the Government Printing Office are products of the Public Domain; and an organization might request that their archives be given credit as to the repository of said document, photos or graphics; but cannot restrict their use nor demand copyrights or links or listings to items which belong to the American People as a whole. Simply locating unusual or hard-to-find items is not a claim to ownership.
Every effort has been made to secure Copyright use
or Permission for everything within this site where applicable;
Any use of disputed material is incidental and should be addressed to the E-mail address below for immediate correction. And we thank all those kind enough to share their wonderful files, histories and personal stories with us. We are successful if we have gotten your attention concerning your own family history; or the history of America.
